Mandalay Hideaway is ideally located between Seminyak (25 minutes) and Ubud (40 minutes) and is just five minutes away from beautiful, untouched beaches and the renowned Tanah Lot temple. Mandalay Hideaway Villa Rental Terms and Conditions:
These Terms and Conditions are accepted by both the owner of Mandalay Hideaway (Owner) and the holidaymaker (Client) as a condition of booking and govern the letting of the Villa by the Owner to the Client. These Terms and Conditions are not valid and effective until the Client has made a confirmed booking and the required deposit has been received by the Owner.
1.1. All rates are quoted in United States Dollars and are inclusive of taxes and service charges.
1.2. Rates do not include: gratuities, meals (apart from breakfast), bar items, wellness services, petrol or any other goods and services which are not mentioned as included on the Mandalay Hideaway website - http://www.mandalaybali.com Meals will be billed according to an approximation of the cost of the ingredients used. Petrol will be billed at pump prices, estimating the amount consumed on the basis of the number of kilometers travelled and the standard fuel consumption rate of the vehicle.
2.1. A deposit of 50% of the total rental amount payable (Deposit) must be received by the Owner within seven days of the Client being provided with the relevant invoice and payment instructions.
2.2. If the Deposit is not paid within seven days, the booking will not be finalised and the dates requested will be unblocked on the Mandalay Hideaway booking calendar.
2.3. Payment of the balance of 50% of the total rental amount payable (Balance Due) is payable at the latest thirty days prior to arrival.
2.4. In the event that a booking is made thirty days or less prior to arrival, the Balance Due is required to be paid together with the Deposit, i.e. within seven days of the Client being provided with the relevant invoice and payment instructions.
2.5. Payments may be made online via credit card or PayPal account or through an international bank transfer.
3.1. Cancellation of a booking includes but is not limited to:
a. cancellation of one or more days of a booking;
b. a request to amend a booking so that none of the dates of the amended booking fall within the same dates that originally constituted the booking;
c. a refusal by the Client to sign the Waiver of Liability and/or Credit Card Authorisation form, and/or failure by the Client and/or one or more of their Guests to provide copies of their passports;
d. an attempt by the Client to hold an Event at the Villa in breach of these Terms and Conditions.
3.2 In the event of a cancellation more than thirty days before arrival, the full amounts paid will be refunded. In the event of a cancellation less than thirty days before arrival but more than fifteen days before arrival, 50% of the total amounts paid will be refunded. In the event of a cancellation less than 15 days before arrival, no refund will be given.
3.3. Notice of cancellation must be received by the Owner from the Client by e-mail and is not considered as received until a confirmation e-mail is sent by the Owner to the Client affirming this.
4. CHANGES TO BOOKINGS
4.1. Changes to bookings may be requested up to 60 days prior to arrival. However their approval is subject to availability.
5. NUMBERS IN PARTY
5.1. The number of persons occupying the Villa, which includes the Client plus their Guests, must not exceed the number stated on the booking confirmation.
6. EVENTS AND PARTIES
6.1. Bookings are for vacation purposes and the Client or their Guests may not hold an event, function or party at the Villa without obtaining prior approval by e-mail from the Owner who in turn will also be compelled to request permission from the local authorities, according to customary Balinese village law. If an event is permitted at the Villa, an event fee, in addition to the local community, or Banjar, fee, will apply. The Owner reserves the right to insist on the appointment of a professional Event Organiser before permission to hold an event is granted.
7. LOSS, DAMAGE AND LIABILITY
7.1. The Client is responsible for leaving the Villa in good order and in a clean condition. The Client agrees to pay for any loss, breakage, or damage caused to the Villa during their stay, including where this occurs during events organised at the Villa. The Owner reserves the right to repossess the premises if the Client or a Guest or invitee of the Client has caused damage or excessive mess, caused a nuisance to the neighbouring community or engaged in illegal activities. The Client agrees to pay for any damages or losses incurred during occupation.
7.2. On arrival the Client will be required to sign a Waiver of Liability and a Credit Card Authorisation Form which will allow Mandalay Hideaway to bill the Client's credit card with any charges that the Client incurs whilst at the Villa, including the cost of any damages that may occur during the Client stay. The Client will also be requested to allow Mandalay Hideaway staff to photocopy both sides of their credit card and both their passport and their Guests passports. The latter is required in order for the staff to complete Client and Guest registration with the local police, a mandatory requirement for all commercial villa rentals in Bali. If the Client refuses to sign the waiver and authorisation form and/or the Client and/or any of their accompanying Guests refuse to provide copies of their passports as is required pursuant to this Clause, then the booking will be deemed cancelled and the terms of Clause 3 will apply.
7.3. The Owner strongly recommends that the Client and their Guests obtain appropriate travel and medical insurance to protect against loss/theft of baggage and personal items, cancellations and other travel contingencies, illness and injury. This should include coverage for medical evacuation.
7.4. The Owner, his employees, affiliates, authorised representatives and assigns will not accept any responsibility or liability, howsoever caused, for any injury, sickness, loss, damage, additional expense or inconvenience that is directly or indirectly caused by the use or condition of the Villa, its plumbing, gas, electrical or other features and fittings, or by exceptional weather conditions. This applies to the Client, to their Guests and to any invitees. Furthermore, no responsibility is accepted by the Owner, his employees, affiliates, authorised representatives and assigns for the personal belongings, vehicles and contents of vehicles of the Client, their Guests or invitees.
7.5. It is the Client's and their Guests' sole responsibility to ensure that every member of the booking party holds appropriate travel documentation to comply with the Laws and Regulations of the Republic of Indonesia for entry to the Republic. This includes a passport with at least six months of validity remaining. The Owner will not provide refunds where the Client or any of their 3/3 Guests do not hold appropriate travel documentation, if they miss their flights or travel connections, or if flights or travel connections are delayed or cancelled.
7.6. It is the Client's and their Guests' sole responsibility to ensure that they comply with the Laws and Regulations of the Republic of Indonesia, and the Owner takes no responsibility for any acts or omissions by the Client in this respect, or by their Guests or their invitees.
7.7. The Owner shall not be liable to the Client for any failure to perform any obligations under these Terms and Conditions due to causes which are beyond the Owner's reasonable control and of a nature which the Owner neither has the power or authority to remedy. Such casues include, without limitation, delayed / cancelled flights, acts of civil or military disturbance, acts of Government, acts of God, power failures, fires, floods, epidemics, wars, riots and acts of terrorism. In the event of such an occurrence, the Owner shall give prompt written notice thereof to the Client where possible and any time for the performance of obligations shall be extended by a time equal to the length of the delay that is attributable to the occurrence in question.
7.8. If the Client considers that they have cause for complaint concerning the Villa, the matter should be taken up promptly with the Villa Manager, who will in turn notify the Owner. All complaints will be investigated and appropriate actions taken. Complaints must be lodged during the Client's stay as opposed to on departure or after departure in order that they may be properly investigated and verified.
8.1. The Owner reserves the right to immediately terminate the Client's stay in the event that the Client breaches one or more of the Terms or Conditions herein.
9.1. These Terms and Conditions are governed by the laws and regulations of the Republic of Indonesia.
